Kiid AI Privacy Policy

Welcome to the Privacy Policy (the “Policy”) of KIID AI, and its related, affiliated or subsidiary companies (collectively, “KIID AI” “we” or “our”). The purpose of this Policy is to inform you how we collect, use, and share your information when you provide such information or use KIID AI’s website available at: www.kiid.ai (the “KIID AI Site”), as well as other related KIID AI’s webpages, products, services, content and applications accessible through the KIID AI Site, including the KIID AI’s web application and its iOS- and Android-based mobile applications (each and collectively, the “KIID AI App”) (collectively the “Services”).

When we refer to “you” or “your” in this Policy we mean any individual who interacts with or uses our Services. By registering for, accessing or using the Services, you represent that you understand and agree to this Policy, and consent to the collection, use, and sharing of information as described in this Policy. If you do not consent to our practices, you can choose not to use the Services.

Privacy Policy Changes. We reserve the right to modify this Policy at any time without notice. All changes are effective immediately upon posting. Your continued use of the Services after changes are posted constitutes your acknowledgement of the modified privacy policy and agreement to abide and be bound by that privacy policy. For reference, the effective date of this Policy is posted at the top of this page. Therefore, it is important that you periodically check this page for changes made to this Policy.

INFORMATION WE COLLECT

Information You Voluntarily Provide

To provide our Services, KIID AI needs to learn certain personal information about you. KIID AI collects information about you when you interact with our Services, including information that you voluntarily provide when you: register and create an account for any of the Services, including when you build your AI Avatar for the KIID AI App; add or update your account information; complete any survey, questionnaire, or form of information request from KIID AI; email us your inquiry to support@kiid.ai; log into the KIID AI Site and/or KIID AI App or use the Services from one or more of your devices, including when you communicate with your own and/or other AI Avatars within the KIID AI App; or when you otherwise interact with the Services. Information that we collect may depend on how you interact with KIID AI and use the Services. The types of information we may collect include, but are not limited to, the following examples.

  • Profile Data such as user name, password, and user settings.

  • Personal Identifiers such as first and last name, date of birth, gender and social media accounts.

  • Contact Information such as your hometown address, email address, and telephone numbers.

  • Educational Information such as school, school status, major studies, minor studies, school residence, clubs, teams, Greek life, and high school.

  • Employment or Professional Information such as job title, employer, and professional affiliations.

  • Input Content and Other Personal Information, including any personal information that you include in any content, data, materials, or information that you put into the Services (“Input Content”), which may include relationship status, relationship interests, political views, religious beliefs, entertainment (e.g. movies, tv, music, video games, art, streamers, etc.), hobbies (e.g. food, astrology, photography, cooking, fashion, fitness, travel, crypto, etc.) sports interests (e.g. football, basketball, baseball, soccer, hockey, tennis, etc.), political views, and any other personal information or interests that you choose to disclose to your own and/or other AI Avatars.

  • Output Content and Memories including any personal information that is created in the output content of the Services (“Output Content”) and in the predictions and learnings from the underlying machine learning and/or artificial intelligence tools and technologies based on your interaction with your and others’ AI Avatars (“Memories”).

  • Geolocation Information such as approximate location information provided by your device, or associated with your IP address (where we are permitted by law to collect and process this information).

  • Usage Data such as information about how you use the Services, such as statistics regarding the opening and clicking on emails, and other activities on Services, including clickstream data, interactions with your own and/or other AI Avatars, time, frequency and duration of your activities on our Services.

  • Device and Diagnostic Data such as error logs, crash reports, and performance analytics.

  • Friends and Other Connections such as information about your friends, groups, and other users and communities you are connected to and interact with. We may also infer information about you based on your friend’s activities and how you interact with these connections.

  • Marketing and Communications Information such as marketing campaign data, click-throughs, your preferences, and consent to receiving marketing from us and third parties, your communication preferences, email, phone calls, text and AI chat communications.

  • Internet and Other Electronic Network Activity such as internet protocol (IP) address, time zone setting and location, language preferences, device type, device specifications, and ID, operating system, and other technical information from the devices you use to access our Services.

  • Audio and Visual Information such as photographs, video and audio recordings and transcripts of your conversations with your AI Avatar and/or other AI Avatars within the KIID AI App.

  • Commercial Data such as products you have purchased, payments you have made, and/or other details of products and services you have purchased from us in the past, purchase or product preferences, personal interests, feedback, reviews, and survey responses.

  • Financial Information such as credit or debit card information, payment details, or other payment information.

Information We Collect When You Use the Services

Automated technologies or interactions. As you navigate around the Site and/or use the Services, certain information can be collected using various technologies to help us personalize your KIID AI experience. This information may include internet protocol (IP) addresses, browser type, internet service provider (ISP), referring/exit pages, operating system, date/time stamp, time zone setting and location, language preferences, device type and ID, and other technical information from the devices you use to access our Services.

Cookies and Tracking Technologies. We and our service providers use cookies, pixels, and other tracking technology to recognize your browser or device and to capture and remember certain information about your activities on our Services with the purpose of delivering customized and personalized services.

  • Cookies. A cookie is a small text file that is saved on your web browser when you visit a website. You can view and delete existing cookies through your browser. If you do not want to store cookies on your computer, you can set your browser to refuse cookies or to alert you when cookies are being sent. However, some parts of the Services may not function properly if you choose not to accept cookies.

  • Pixel Tags (aka clear gifs). These are tiny graphics with a unique identifier, similar in function to cookies, which allow us to monitor the use of our Services, for example, to count users who have visited those pages and for other related website statistics. Pixel tags generally work in conjunction with cookies, registering when a particular device visits a particular page. You cannot decline pixel tags; however, if you turn off cookies the pixel tag will simply detect an anonymous visit. In addition, we use pixel tags in our HTML-based emails to let us know which emails have been opened by the recipients. This allows us to gauge the effectiveness of certain communications and the effectiveness of our marketing campaigns.

  • Analytics. We use third party cookies provided by Google Analytics to assist us in better understanding our Site’s visitors. These cookies collect IP address and usage data, such as the length of time a user spends on a page, the pages a user visits, and the websites a user visits before and after visiting our Site. In addition to reporting usage statistics, Google Analytics can also be used to help show more relevant ads on Google properties (like Google Search) and across the web. You can also opt out of advertising cookies using the Google Ad Settings.

Information You Provide to A Third Party

We may receive information about you from third parties. We may associate this information with the other information we have collected about you as described in this Policy. The collection, use, and disclosure of information received from third parties may be governed by the third parties’ privacy policies. Please carefully review these third-party privacy policies before submitting your information to a third-party application or otherwise interacting with it to understand how your information may be collected, used, and disclosed by these third parties. We have no control over, and cannot and do not assume responsibility for the data collection and privacy practices employed by any of these third parties or their services.

Third Party Service Providers. We collect information from service providers including payment processors, email service providers, website hosting platforms, and analytics providers.

Third Party Advertising Partners. We collect information received from third party advertising partners, including partners who host and manage various online advertisements and ad platforms. This may be combined with the website analytics data described above.

Third Party Avatar Services. The Services are integrated with a third-party service provider that we use to create your Avatar. Any information, including any pictures uploaded using this third-party service will be subject to the service providers terms and privacy policy.

USE OF YOUR INFORMATION

Our primary purpose for collecting your information is to provide you with the services you request. We may also use your information in order to:

  • Provide you with our Services and to operate our business.

  • Customize, measure, improve and personalize our Services and content, including by training and fine tuning our underlying software programs, algorithms, machine learning , artificial intelligence tools and to display, transmit, and share Input Content and associated Output Content with other users of the Services in accordance with your account settings and the features of the Services. For example, we use and analyze your information to tailor our Services to your specific needs, such as personalizing your AI Avatar, the content, documents, correspondence recommendations, and features you see when using our Services, and developing algorithms to help us execute on your requests more efficiently.

  • Verify your identity and account information in connection with those of our Services you request.

  • Provide you with required notices and updates about our content, products, and services, as well as other important information.

  • Conduct our own internal business processes and further our internal business purposes. For example, we may also use your information for conducting business planning and analysis, auditing, reporting, forecasting and to enforce or apply our Terms of Service and other agreements you have entered into with us. We may also use the information we collect in either an identifiable or an anonymized form for several purposes including, but not limited to, the following, as is necessary:

    • to refine fine-tuning processes at KIID AI;

    • to administer the Services and for internal operations, including troubleshooting, data analysis, testing, research, system maintenance, support, report, statistical and survey purposes;

    • to improve the Services and to customize the content you see on the Services;

    • as part of our efforts to keep the Services safe and secure, including by moderating, editing, formatting, restricting distribution, or removing Input Content, Output Content, or Memories for purposes of safety, compliance, or product improvement;

    • to measure or understand the effectiveness of advertising we serve to you and others, and to deliver relevant advertising to you; and

    • to do internal research on our Services visitors’ interests and behaviors to better understand and serve our customers.

  • Use Output Content and Memories generated through your interactions with the Services to provide, enhance, and personalize features for you and other users, and to improve our AI models and algorithms.

  • Provide you with recommendations to suggest you add a friend, join a group, attend events, restaurants, and other community activities.

  • Provide you with recommendations for content, products, and services that we believe would be of interest to you, including third party ads.

  • Assist you with setting up and managing your account with us.

  • Resolve disputes and questions about our Services.

  • Enforce our Terms for use of our Services and the terms of this Policy.

  • Communicate with you about content, products, services, updates, events, promotional offers, research, insights, and other information that may be of interest to you from us and our trusted partners.

  • Protect our interests, including establishing, exercising, and defending legal rights and claims.

  • Comply with legal requirements, prevent fraud, co-operate with law enforcement and regulatory authorities, and stop other prohibited, illegal, or harmful activities.

  • Further the purposes disclosed at the time you provide your information or we request your information, or as otherwise set forth in this Policy.

INFORMATION WE SHARE

  1. Service Providers

We may use third-party service providers, to perform certain business services and may disclose your information to such service providers as needed for them to perform these business services. Service providers are only allowed to use, disclose, or retain this information to provide these services. Business services provided include, but are not limited to, hosting services; account authentication and user verification services; marketing, promotional and email services; customer and technical support services; AI and large language model providers, analytics services, quality assurance testing, and back-office support for the Services.

  1. Internal Third Parties

We may share your information with our affiliated entities, successors, predecessors, assigns, licensees, or business partners, and others who may use the information for the purposes described above.

  1. Business Transactions

We may do business with third parties to whom we may choose to sell, transfer, or merge parts of our business or our assets. Alternatively, we may seek to acquire other businesses or merge with them. If a change happens to our business, then your information may be transferred to the new owners who may use your information in the same way as set out in this Policy.

  1. Legal Process

Subject to applicable law, we may disclose information about you i) if we are required to do so by law, regulation, or legal process, such as a subpoena; ii) in response to requests by government entities, such as law enforcement authorities; iii) when we believe disclosure is necessary or appropriate to prevent physical, financial, or other harm, injury, or loss; or iv) for the purposes of cooperation with law enforcement agencies’ and/or in connection with an investigation of suspected or actual unlawful activity.

  1. Information You Share.

Your profile information, including your name, school, mutual friends and Avatar will always be public and visible to other users. Some personal information is disclosed as a matter of course as a result of your use of our Services. You can choose what information you share with different people using your privacy settings. Any personal information shared with other users or in a public forum using our Services can be collected, copied, recorded, and live-streamed by other users, and shared on and off our Services. Please consider carefully who you interact with and how you conduct yourself, and make sure your available privacy settings reflect your preferences. You assume all responsibility for any loss of privacy or other harm resulting from your own voluntary disclosure of personal information with other users or in shared and public forums.

COMMUNICATIONS AND OPT-OUT

Depending on your marketing settings and preferences, we may use your information to let you know about our products, services and offers or other initiatives that may be of interest to you and we may contact you to do so by email or push notification. While we value our communications with you, if you do not want KIID AI or its representatives to contact you for marketing purposes, you may opt-out of this preference at any time by following the instructions below.

Email. You may opt-out of promotional emails by following the unsubscribe instructions included in the email. This opt-out will not apply to operational or informational emails related to your account or other administrative purposes or other such communications for which we have a legal obligation to inform you and/or to prevent fraud or harm to our Services, our business, and/or third parties. You may continue to receive promotional email messages for a short period while we process your request.

Push Notification. Where you have chosen at a device level to begin or continue receiving push notifications from us, we may send you push notifications relating to our products, services, offers and other marketing initiatives. You can choose to stop receiving push notifications from us at any time by changing your preferences on your mobile device.

CHILDREN

The Services are intended for users aged fourteen (14) and older. If you are under the age of fourteen (14), you are not authorized to provide us with any personally identifying information, nor access or use our Services in any manner whatsoever. By using the Services, you represent that you are fourteen (14) years of age or older. 

USE OF THE SERVICES

By accessing and using the Services, you acknowledge and agree that we control and operate the Services from our offices in the United States of America and that the Services are intended for use by users located in the United States of America. Unless expressly stated to the contrary, we make no representation that the Services are appropriate or will be available for use in other locations.

NOTICE TO CALIFORNIA RESIDENTS

Your California Privacy Rights. California Civil Code Section 1798.83 permits California residents who have provided personally identifiable information to us or our third-party advertisers and marketing partners, if any, to request certain information regarding our disclosure of personally identifiable information to third parties for their own direct marketing purposes. Requests should be submitted via email to tos.privacy@kiid.ai and should include CALIFORNIA PRIVACY RIGHTS in the subject line. Please be aware that not all information sharing is covered by the requirements of Section 1798.83 and only information on covered sharing will be included in our response. This request may be made no more than once per calendar year.

Your ‘Do Not Track’ Browser Setting. Some web browsers incorporate a Do Not Track (“DNT”) feature that signals to the websites that you visit that you do not want to have your online activity tracked. Our KIID AI Site does not respond to DNT signals. We may allow certain third-party advertising partners to place tracking technology, such as cookies and pixels on our Services. This technology allows us and/or third-parties to collect personally identifiable information about your online activities over time and across different websites.
